Day Care Exemptions – Ontario

Ontario’s Day Nurseries Act has a provision for legal exemption from vaccination, and you would use “Statement of Conscience or Religious Belief Affidavit 4897-64E” contained in the Immunization of School Pupils Act as the official document with which you can claim exemption from vaccination for your child. This affidavit must be signed and stamped by a commissioner of oaths, notary public or a justice of the peace. Commissioner of oaths are available at most municipal offices as well as MP and MPP’s offices. Call ahead to confirm, fees may apply, and you will require identification. We recommend parents keep a signed and stamped copy in their own files at home.

Ontario’s Day Nursery Act: which stipulates under Health and Medical Supervision, sections 30-38; subsection 2, that, “Subsection (1) does not apply where a parent of the child objects in writing to the immunization on the ground that the immunization conflicts with the sincerely held convictions of the parent’s religion or conscience or a legally qualified medical practitioner gives medical reasons in writing to the operator as to why the child should not be immunized.”
